These Terms and Conditions (“Terms”) govern your access to and use of websites, mobile applications, maps, listings, communication tools, subscriptions, and related services provided by Daily Map Inc. (“Daily Map,” “we,” “our,” or “us”), collectively referred to as the “Services.” By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. About Daily Map
Daily Map provides tools that may help users discover truck repair shops, truck stops, dealers, and other service locations. We may also provide business listing management, verification, promotion, analytics, subscriptions, customer communications, and fleet or vehicle visibility through third-party integrations.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, and legally capable of entering into a binding agreement. If you use the Services on behalf of a company or other entity, you represent that you have authority to bind that entity to these Terms.
3. Accounts and Information
Some features may require an account. You are responsible for safeguarding your login credentials and for activity under your account. You agree to provide accurate, current, and complete information and to update it when necessary.
4. Acceptable Use
You agree not to:
- use the Services in violation of any law, regulation, or third-party right;
- submit false, misleading, fraudulent, infringing, or unauthorized information;
- interfere with the operation, security, integrity, or availability of the Services;
- scrape, harvest, copy, or extract data at scale without our written permission;
- attempt unauthorized access to accounts, systems, networks, or data;
- upload malware, harmful code, abusive content, or unlawful material;
- impersonate another person, business, or entity.
5. Listings, Profiles, and Business Content
If you submit, claim, verify, or manage a listing, you represent that you have the right to provide and manage that information and that it is accurate, current, and not misleading. You remain responsible for business details, services, hours, photos, contact information, website links, and promotional content you provide.
We may review, edit, reject, suspend, remove, or reclassify listings or submitted content when reasonably necessary to maintain platform quality, comply with law, enforce these Terms, or address disputes, fraud, or abuse.
6. Ratings, Reviews, Maps, and Third-Party Data
Daily Map may display information obtained from third parties, including ratings, reviews, review volume, business details, maps, directions, and location data. We do not guarantee that third-party information will always be accurate, complete, current, lawful, or available.
7. Integrations
Certain features may rely on third-party integrations, such as Samsara. By connecting an integration, you authorize us to access and process the information made available through that integration as necessary to provide the requested functionality. Your use of third-party services remains subject to their own terms and privacy policies.
8. Subscriptions, Packages, and Payments
Some Services may be offered through paid packages, subscriptions, invoices, or third-party payment processors. Pricing, included features, billing frequency, renewal terms, and cancellation terms may be presented at the time of purchase or in a separate commercial agreement.
Unless otherwise stated or required by law, fees are non-refundable. We may change pricing or package features prospectively by providing notice where required.
9. Communications: Why We Need Contact Information
Daily Map may collect and use phone numbers, email addresses, and related contact information to:
- create, verify, and manage accounts or business listings;
- verify business ownership or authorized representation;
- respond to inquiries and provide customer support;
- send information requested by you;
- send account, security, service, billing, appointment, or operational notices;
- communicate about subscriptions, listings, products, and services;
- send promotional or marketing communications when you have provided the required consent;
- record and honor communication preferences and opt-out requests.
10. Communication Consent and Opt-In
You may consent to receive communications from Daily Map Inc. by SMS or text message, live or prerecorded voice call, email, website communication, or another authorized channel. Communications may include service-related, transactional, informational, support, verification, account, and promotional messages, depending on the consent you provide.
a. Accepted opt-in methods
Consent may be collected through:
- a website form;
- an unchecked checkbox selected by you;
- an SMS keyword or SMS response;
- an email response or email consent request;
- verbal consent during a telephone or voice call;
- verbal consent during an in-person interaction;
- a written or electronic authorization;
- another clear affirmative action that records your consent.
b. SMS terms
By opting in to SMS communications, you authorize Daily Map Inc. to send text messages to the mobile number you provide. Message frequency may vary. Message and data rates may apply. Consent to receive marketing text messages is not a condition of purchasing goods or services. Mobile carriers are not liable for delayed or undelivered messages.
11. Opt-Out and Withdrawal of Consent
You may withdraw consent or request that communications stop at any time by:
- replying STOP to an SMS message;
- using an unsubscribe link in an email, when available;
- sending us an email opt-out request;
- calling us and requesting removal;
- telling a Daily Map representative in person;
- submitting a request through our website or account settings, when available.
We will process opt-out requests in accordance with applicable law and the relevant communication channel. Opting out of marketing messages does not necessarily prevent us from sending messages needed to complete a requested transaction, deliver a requested service, protect your account, comply with law, or confirm the opt-out.
12. Phone Number and SMS Privacy
Daily Map Inc. does not sell, rent, or trade customers’ phone numbers, SMS consent, or personal information to third parties for their independent marketing purposes. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.
We may use communications vendors, carriers, hosting providers, and other service providers to operate the Services and deliver messages on our behalf. Such providers are permitted to use information only to perform services for Daily Ma or as required by law.
13. Privacy
Your use of the Services is also subject to our Privacy Policy, which explains how we collect, use, disclose, retain, and protect information, including phone numbers, communication preferences, and consent records.
14. App Store and Mobile Platform Terms
If you download a Daily Map application through Apple’s App Store, Google Play, or another platform, your use may also be subject to that platform’s terms. Platform providers are not responsible for operating the Services except as required by their applicable rules.
15. Intellectual Property
The Services, including software, branding, design, text, graphics, databases, and compilations of content, are owned by Daily Map or its licensors and are protected by intellectual property laws. Except as expressly authorized, you may not copy, modify, distribute, sell, reverse engineer, or create derivative works from the Services.
16. Feedback
If you provide suggestions, ideas, or feedback, you grant Daily Map a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and incorporate that feedback without restriction or compensation.
17. Availability and Changes
We may modify, suspend, or discontinue any part of the Services at any time, subject to applicable law and any separate written agreement. We do not guarantee uninterrupted availability or that every feature will remain available.
18. Disclaimers
The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Daily Ma disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and availability.
Daily Ma is an informational and operational platform. We do not guarantee the performance, quality, legality, safety, availability, or suitability of any listed shop, service provider, dealer, advertiser, or other third party.
19. Limitation of Liability
To the fullest extent permitted by law, Daily Map and its affiliates, officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising from or related to the Services.
To the fullest extent permitted by law, Daily Map’s aggregate liability for claims related to the Services will not exceed the greater of the amount you paid to Daily Map during the 12 months before the claim arose or one hundred U.S. dollars (US$100).
20. Indemnification
You agree to defend, indemnify, and hold harmless Daily Map and its affiliates, officers, employees, contractors, and licensors from claims, liabilities, damages, judgments, losses, costs, and expenses arising from your content, your use of the Services, your violation of these Terms, or your violation of law or third-party rights.
21. Suspension and Termination
We may suspend or terminate access to the Services if we reasonably believe you violated these Terms, created legal or security risk, misused the Services, or where suspension or termination is necessary for operational, legal, or security reasons. You may stop using the Services at any time.
22. Governing Law
These Terms are governed by the laws applicable to Daily Map Inc. in its jurisdiction of organization, without regard to conflict-of-law principles, except where another law must apply. The governing-law and venue language should be reviewed and completed based on Daily Map Inc.’s state of incorporation and principal place of business before publication.
23. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted with a revised effective date. Continued use of the Services after the revised Terms become effective constitutes acceptance to the extent permitted by law.
